AGREEMENT. TERMS OF USE OF PILATES FLOW
§ 1
GENERAL PROVISIONS
These Regulations define the rights and obligations of the Clients of the Pilates Flow Studio (hereinafter: “Regulations”) conducted by the company Massage&Spa Anna Szczerba NIP 8942480688 52-200 Wysoka 1 Fiołkowa Street (hereinafter: “Studio”).
The studio provides physical activity services at ul. Grabiszyńska 200 B, Wrocław Under the terms of these Regulations.
§ 2
DEFINITIONS
The terms used in these Regulations shall mean:
Studio – Pilates Flow studio at 200 B Grabiszyńska Street in Wroclaw owned by Massage&Spa Anna Szczerba.
Website – the website with the address: www.pilatesflow.pl
Website – Internet service at www.fitssey.pl run by lightenbody™, based at 11/819 Heveliusza Street, 80-890 in
Gdansk, Poland, NIP 7532294721, REGON 362814110
Client – a person using the services provided by the Studio. The Client may be a person of full legal age, having full legal capacity, or a minor having written consent of his/her legal representative to use the services of the Studio.
Instructor – a person authorized to conduct classes at the Studio.
Agreement – an agreement for the provision of services concluded between the Client and the Studio for a definite period of time.
The Agreement is concluded by selecting the appropriate Pass and paying the fee in accordance with the price list of services located on the Website in the price list tab and at the Studio. If the Client fails to pay the fee for the
Pass, the Agreement is not concluded.
Pass – a single class or a package of classes.
Details of the Studio, classes, Instructors and Passes can be found on the Website.
§ 3
PRINCIPLES OF SERVICES PROVIDED
The Client has the right to use the services of the Studio on the basis of the concluded Agreement to the extent resulting from the purchased Pass in accordance with the price list of services located on the Website in the price list tab, in the Studio and on the Fitssey Website.
The Pass is active a pass of 4 entries, 8 entries is active 30 days, a pass of 10 entries is active 45 days.Failure to use the Pass during the period is forfeited without the right to refund payment.
The price of the Pass does not include accident insurance. After payment, access to the Pass is possible through the Fitssey Service. The Pass is personal and cannot be used by third parties, it cannot be suspended or assigned to another person.
Classes are held in accordance with the schedule posted on the Website in the schedule tab and in the Studio. The Client declares his/her intention to participate in the classes by signing up for them via the Website. Due to the limited number of places in groups, the right to participate in a given class is determined by the order of registration.
The Client is obliged to inform the Studio about cancellation of participation in organized classes at least 24 hours in advance. The Client shall make notification of the intention to cancel through the Fitssey Service. In case of cancellation less than 24 hours in advance and the Client’s non-participation in the class, not resulting from changes in the Studio’s schedule, the Client will not be entitled to a refund of payment.
The studio reserves the right to cancel classes in the event of fortuitous events or technical/maintenance work that makes it impossible or difficult to conduct these classes. The Studio reserves the right to change the schedule of organized classes and the person conducting the classes. The change takes place after prior notification to the Client by at least one of the following means: electronically (e-mail / SMS) or by posting the information on the Website www.pilatesflow.pl.
Change of the type of Pass is possible with effect at the end of the activity of the purchased Pass. In case of changing the type of the Pass, the Customer will switch to another Pass of his/her choice at the price specified in the currently valid price list located on the Website and Studio.
The instructor has the right to verify the Customer’s data indicated during the reservation on the Fitssey Website on the basis of the identity document presented. If the identity document is missing, the Studio Staff has the right to refuse entry to the Studio or order the Client to leave the Studio.
The Agreement shall be terminated at the end of the last day of the Pass period.
The Agreement is subject to termination with immediate effect by virtue of a statement by the Studio, if the Customer grossly or persistently violates the rules of order in the Studio or the provisions of these Regulations. The Agreement is subject to termination with immediate effect by virtue of a written statement submitted by the Client to the address of the registered office of Z Krainy Marzeń s.c., if the Studio grossly and persistently violates the provisions of these Regulations.
Pilates and Yoga Studio reserves the right to change the instructor leading the class. We would also like to point out that these changes can be made without prior notice to participants.
If the minimum number of participants does not gather, i.e. 2 people for Pilates training and 3 people for Yoga classes, the classes may be canceled. In such a situation, participants will be informed by phone or email.
The entrance fee will be refunded to the client’s account.
§ 4
RULES FOR USING THE STUDIO
Customers have the right to use the services of the Studio to the extent of the Passes purchased. On the premises of the Studio it is strictly forbidden to consume alcohol, smoke, use electronic cigarettes, use and possess any intoxicants, come in a state of intoxication, intoxicated or under the influence of drugs, and bring dangerous tools and objects.
It is forbidden to record video and audio on the premises of the Studio without the consent of the Instructor.
It is prohibited to bring animals into the Studio premises.
Clients are required to maintain peace and order in the Studio and allow other Clients to freely use the Studio’s services.
In the Studio, classes are held without footwear, which the Client should leave in the locker room.
Chewing gum is prohibited during classes.
Clients are required to attend classes in comfortable clothing with no protruding sharp parts such as zippers, snaps or rhinestones that could damage the Studio’s equipment.
During classes, all instructions and comments of the Instructors must be followed.
The Client is obliged to use the Studio premises, equipment and facilities in accordance with their intended use.
The Client is obliged to maintain order in the Studio premises. The Client is obliged to put the equipment in its proper place after the end of the class.
For organized classes, the Client is obliged to come to the Studio in advance in order to properly prepare for the class. In case of lateness exceeding 10 minutes for safety reasons, Clients may not be allowed to participate in the class.
Leaving the exercise room before the end of a structured class requires informing the instructor in charge of the class.
Clients using the Studio classes for the first time are required to inform the Instructor. Before the class, it is mandatory to show the Instructor the Pass authorizing the use of the services.
In case of ill health, injuries, injuries and other health problems and pregnancy, it is necessary to inform the Instructor before the class. In the event of an accident, injury, injury, the client is obliged to immediately report it to the Instructor.
The Client is obliged to observe the rules and regulations of the building in which the Studio is located.
Out of concern for the safety of all persons using the Studio, persons violating the rules of order and the provisions of these Regulations, in particular persons who are on the premises of the Studio in shoes, persons under the influence of alcohol or intoxicants, persons behaving aggressively, persons possessing or using dangerous tools will be asked to leave the Studio.
The use of advertising materials and photographs of the Studio by third parties is prohibited.
§ 5
CHECKROOM
The client is obliged to leave his/her belongings in the designated locker room in the Studio, which he/she undertakes to take away immediately after the class. It is forbidden to enter the hall with backpacks, bags, purses or any other luggage, even hand luggage. The Studio will not be responsible for items left in the locker room or elsewhere on the Studio premises.
§ 6
RESPONSIBILITY
The Studio shall not be liable for damage to health, bodily violations, loss of health, illnesses suffered by the Client as a result of the use of services, facilities and equipment at the Studio, in particular, if they were a consequence of health contraindications, pre-existing diseases, improper use of equipment and facilities, improper exercise, lack of proper warm-up, lack of focus and commitment to the class, and other violations and negligence of the Client.
§ 7
PERSONAL DATA
The Administrator of the Customers’ Personal Data is the company Massage&Spa Anna Szczerba NIP 8942480688 52-200 Wysoka 1 Fiołkowa St. The Customers’ Personal Data is processed in accordance with the provisions of the law, including the provisions of the Personal Data Protection Act. The Customer has the right to access his/her Personal Data, correct it, limit its processing, transfer it, file an objection, the right to delete the data, and to the extent that the data is processed on the basis of consent – the right to withdraw it at any time without giving any reason, effective from the withdrawal of consent.
The rules for the processing of Personal Data are set out in a separate document “Privacy Policy”, the content of which is available at the Studio and on the Website www.pilatesflow.pl.
§ 8
FINAL PROVISIONS
Before using the services of the Studio, the Client is required to read these Regulations. The instructors of My Healthy Place have the knowledge, experience and education necessary for the proper and safe conduct of classes and workouts. Clients participating in classes declare that they have no health contraindications to exercise and participate in classes at their own risk. People with health problems should consult a doctor before attending classes. The Studio is not responsible for the consequences of not following the Rules and Regulations. Its violation entitles the Club to withdraw from the contract immediately, with no refund for remaining entries. Making a class reservation indicates acceptance of these Rules. Ignorance of these Rules and Regulations does not release you from the obligation to comply with them.
The Regulations shall come into force on 21.09.2023. The Regulations are subject to change, of which the Studio will inform the Client by posting the relevant information on the Website. If the Regulations are changed, the Client has the right to terminate the Agreement without notice effective on the last day of the term of the Pass. The deadline for submitting a declaration of intent to terminate the Agreement is 14 days from the time of posting information about the change in the Regulations by completing the declaration which is Appendix 1 of this Agreement and returning it by mail to the address of the company Z Krainy Marzeń, with the date of mailing being binding. If the customer has not submitted a statement of intent to terminate the contract within 14 days, it is equivalent to acceptance of the changes made to the Regulations.
The Studio has the right to change: the schedule of classes. the price list of services, the scope of services provided, e.g. by withdrawing a particular type of classes from the offer, the person of the trainer conducting the classes and the hours of conducting particular classes. These changes do not constitute an amendment to the Agreement, as well as to the Regulations.
In matters not covered by these regulations, the provisions of the Civil Code will apply.
§ 9
ADVERTISEMENTS
A Club Member may submit complaints regarding the provision of Services by the Club in person at the front desk, by mail to the Club’s address or by e-mail to the electronic address kontakt@pilatesflow.pl.
In the complaint the Club Member should indicate his/her name, contact details, signature, and briefly describe the situation.
The Club will promptly, but not later than within 30 days, consider complaints and respond to the e-mail address provided in the complaint application.
§ 10
WITHDRAWAL
The Client may, without giving any reason, withdraw from the Agreement within 14 days, from the date of purchase of the pass, and may return the purchased pass authorizing participation in classes at the studio, with the proviso that the reimbursement of the costs incurred for the pass will be reduced by the classes used up to the date of submission of the withdrawal.
The Client may withdraw from the Agreement by submitting a statement of withdrawal to the Service Provider. The statement may be submitted in writing at the reception desk of the studio or by e-mail to kontakt@pilatesflow.pl.
In the event that the Client’s statement of withdrawal from the Agreement is received electronically, the Service Provider will immediately send the User a confirmation of its receipt.
